You would think that they would have just released this little fella' to his
parents. Oh, wait! This guy is 33 years old. You would think at 33 years of
age, he would have grown up by now.

But, I do agree, the punishment does not fit the crime. Maybe they should
just let Dennis throw a water balloon at him.

Bush hasn't grown up and he's in his late fifties. These are times that
call for vehement protest. Bush has railroaded this country into war on
what are now being called "technicalities" and is preparing to turn our
country into a police state via the unPatriot Act (1 and 2) while people
are distracted. That justifies throwing a couple balloons.

It doesn't harm kids when they throw them and it doesn't harm adults
either. Last time I checked, a water balloon is not a weapon of mass
destruction. If Bush and Hasturd want to redefine it as such then
hopefully americans will recognize these maneuvers as bullshit.

You don't understand. You know it was water. The thrower knew it was water.
It was the *threat* that it was something more dangerous. The facts don't
matter. The perceived threat is what matters.

How does this address the requirement that serious bodily harm needed to
be done in order to call this aggravated assault? How does this address
the fact that aggravated assault needs to have intentionality. I agree
that they didn't know what substance was in the balloons. But that would
make all water balloon throwing "aggravated assault", by such a standard,
now wouldn't it? Kids throw water balloons all the time. How many of
them will we have to lock up if we follow the hastert example? I know
this guy was older and all, but this is typical gestapo action by the
secret service. Bush's goon squad in particular always seems to be
looking for ways to get protesters on overblown charges.

I assure you that as a matter of law the facts very definitely *do*
matter.

Perceived threats can also matter. But I'm not sure that most people
would consider this to be a reasonable "threat". In addition, the type
of "threat" involved in battery is a communicated intention to do bodily
harm, not a threat in the sense of an inferred potential danger.

Was that what Bush was drinking when he decided that saddam was a threat
to the security of the world, or was it something a bit stronger perhaps?

You are quibbling with the trivial side of metaphor I was creating rather
than discussing the side that really matters.

I see. What metaphor is that. The water balloon was not a metaphor. It
was a real balloon filled with water. I said that I agreed, it could
contain other things. It could have contained sarin for all they knew.
But the fact that security was inadequate to prevent someone from
throwing a water balloon with a chemical or biological agent in it does
not make this man's actions any more severe. The fact is that he only
threw an ordinary water balloon and that is all that he can be charged
with. If a cop shot a person for throwing a water balloon, he could
claim he thought it was a lethal hand grenade. But it would still be
wrongful death, because in fact it was not a lethal weapon.
